1. DEFINITIONS

In these terms, "You" and "Your" refer to the customer and "We", "Us" and "Our" refer to Xtreme Consoles Ltd.

2. COPYRIGHT

You may copy the contents of this site for the following purposes only; downloading for viewing later, for internal or private use, or to submit to us with instructions.

You may not include a link to this website or display the contents of this website surrounded or framed or otherwise surrounded by material not originating from us without our prior written consent.

3. ORDER ACCEPTANCE

1.1 A contract for the sale of product(s) you order from us is only created once we have e-mailed you confirmation of your order and your order number. If the order includes a Trade-in the contract is only created after we have accepted the Trade-in.

1.2 Orders are subject to availability.

1.3 We will not be legally bound by any factual or typographical errors on the website or other promotional materials.

4. TRADE-INS

4.1 Trade-ins must be in full working order and the condition ofthe Trade-in must be as described on the Trade-in request form by you and must include all items selected on the Trade-in request form by you.

4.2 No cash or equivelent substitute can be issued. If the value of the Trade-ins exceed the price of the product(s) you are purchasing, the difference less other expenses will be credited to your account for redemtion against future purchases.

4.3 Certain titles may be excluded at our descretion.

4.4 You must pay a minimum transaction fee up-to a maximum of £2.50 Pounds Sterling for each order that includes trade-ins if the total order price is less than £2.50 Pounds Sterling.

4.5 We reserve the right to change the value price of a Trade-in at any time during or after the order process until a contract for the sale of product(s) has been created.

4.6 Receipt of a Trade-in does not confirm acceptance of the Trade-in.

4.7 We reserve the the right to reject any trade-in for any reason.

4.8 You must pay all expenses incurred by Us including but not limited to postage and packaging costs prior to returning rejected Trade-ins.

5. DELIVERY

2.2 You shall be given an estimated time for delivery when your order is placed. If the goods are not available for delivery within 30 days of being ordered you will be entitled to cancel your order and receive a full refund. Where goods become available for delivery at different times we reserve the right to deliver them in stages.

2.3 Once the goods have been delivered to you, you will hold them at your own risk and will be liable for their loss or destruction. We will not be liable for the loss or destruction of the goods once they have been delivered to you.

6. CANCELLING YOUR ORDER

2.4 If you decide you do not require the goods, you may return the goods to us within ten days from the date on which you received them provided they are returned in their original packaging, unopened and in perfect condition. We shall refund the purchase price of the goods within 30 days of the order being cancelled. Goods supplied direct from a manufacturer will be subject to the returns conditions of that manufacturer. If any goods are returned damaged we reserve the right to make a charge relating to our costs of processing the sale.

7. RETURNING PRODUCTS

2.4 If you decide you do not require the goods, you may return the goods to us within ten days from the date on which you received them provided they are returned in their original packaging, unopened and in perfect condition. 8. LIABILITY & DISCLAIMER

To fullest extent permitted at law and except in respect of death and personal injury caused by negligence on our part or on the part of our employees we shall not be liable to you by reason of any representation (unless fraudulent), or any implied warranty condition or other term or any duty at common law or under express terms of the contract for any indirect, special or consequential loss or damage (whether for loss of profit or otherwise), costs, expenses or other claims for compensation whatsoever (whether caused by negligence on our part or the part of our employees or agents or otherwise) which arise from or in connection with the use of the website, the supply of goods or their use or resale by you, and our entire liability under or in connection with the contract shall not exceed the price of the goods, except expressly provided in these conditions. This does not affect your statutory rights.

9. FORCE MAJEURE

We reserve the right to delay delivery or to cancel the order or reduce the volume of the goods ordered by you (without any liability to you) if we are prevented from or delayed in the carrying on of our business due to circumstances beyond our reasonable control including without limitation acts of God, governmental actions, war or national emergency, riot, civil commotion, fire, explosion, flood, epidemic, lock out, strikes or other labour disputes (whether or not relating to either party's work force), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials Provided that if the event in question continues for a continuous period in excess of 14 days, you shall be entitled to give us notice in writing to terminate the order.

10. INVALIDITY

In the event that any clause in this contract is deemed to be unenforceable, the enforceability of any other part of these conditions will not be affected

11. GOVERNING LAW & JURISDICTION

This Agreement will be governed by and construed in accordance with English law

From time to time we may offer links to other sites where we consider they share our values and may be of interest to You. Given that they would be separate sites we are not responsible for their content, security or information collecting policies or availability.
